supreme court never meets
open any newspaper and you will headlines like "supreme court decides this" or "supreme court decides that" or "supreme court stays this order or that order".
it is all false. newspaper are making fools of us which, incidentally , they feel is their duty. after all money is obtained by making other people fools. all the scamsters follow this rule. the other reason may be that the editing staff has nothing better to do.
actually supreme court decides nothing, passes no orders, grants no stay. in fact, the supreme court never meets. only time they really meet is when someone is retiring and they have all tea (and actually much more). apart from that – never.
but why these headlines. as said before, the ignorant editor finds it interesting.
what is the truth?
some two members do something and people are made to believe that supreme court did it. actually, if there were some other members, instead of these two, the orders may be quite contrary.
but there is rogue agreement never to differ. even so, sometimes conscience pricks ( no one knows how it could survive in such heat). so two members disagree with other two. what happens then to the so called supreme court decision. there are two contrary decisions now. quote whichever you like.
in such situation, a safety valve has to be there. it come in the form of three members bench. it is believed that three heads are better than two. but only if they are looking in the same direction. sometimes the three members find it a bit hot, even after being used to hot stuff. so it is handed over to bench of five members. other 28 or 30 sit with crossed fingers in their own chambers wondering where the world is going. sometimes the five members hear the case for months and when it is nearing conclusion, they get scared a they recommend for a still larger bench.
however another safety valve is operational also. one of the members departs, upon attaining the age for departure. so the whole thing is started ab initio with a new set of members. with this simple stratagem, the difficult decision can be postponed indefinitely.
but as i said before, supreme court never meets. if they were to do so, there will be finality and the advocates, partner in the game, will be left high and dry. everyone will suffer.
so let us continue to enjoy the headlines (if it suits us) and be angry (if it does not suit us).
