Legality vs. Morality


So live in is not illegal. Obviously not. Nor is adultery. If two consenting adults indulge in these things, how can any one object. After all constitution guarantees freedom of expression. Under these circumstances, why did High Court ban making money out of the honeymoon that Raul Mahajan and his wife had in some foreign land? What they were doing was not illegal. If the people wanted to pay for their out of India romance, what was wrong with it. Any way judiciary knows best.


What we should be concerned with is where it will stop. The society has its own norms. They are sanctified by time. In course of time, the tradition acquires the same sanctity as granted to laws. If the behavior of some individuals offends other members of the society, should they have a right to object. There is certain behavior which is appropriate for the bedroom and is sacred but should it also be allowed in the parks. After all the consent will still be there and therefore, legally, it would be correct behavior.


The judgment raises these basic questions. Who will answer them.
